The case of David Ooga Mokaya, a fourth-year student at Moi University, has taken an intriguing turn. Mokaya, who faces charges of publishing false information and sharing a fabricated image of President William Ruto's funeral procession, is now asking the court to summon President Ruto to testify in the case.


The image in question, which showed military personnel in ceremonial uniforms and a casket purportedly containing the president’s remains, was posted by Mokaya and later found to be fabricated. The court has been informed that the photo was intended to falsely suggest that the president had passed away.


Mokaya’s defense, led by the Law Society of Kenya, has filed a request for the Director of Public Prosecutions (DPP) to provide witness statements, particularly from President Ruto himself, given his role in the case. The defense also questioned the jurisdiction of the court, given that Mokaya was arrested in Eldoret.

The case has sparked debate about freedom of speech, with Mokaya’s lawyers arguing that the charges are politically motivated and could be an embarrassment for President Ruto to testify about his own “death.” The matter will be mentioned again on January 28, 2025, when the court will decide on jurisdiction. Mokaya, who denies the charges, remains out on bond.
